If the damage is less than $5000, you can take the company to small claims court. You don't need a lawyer for that, in fact lawyers are not allowed. Lawyers usually wouldn't want to bother with a case that small anyway.

You can't claim anything on ';could'; or ';may have';. Find out if there is any damage--the only loss you have is a couple quarts of oil. Have you talked to ';Goodyear'; yet. Of course you didn't do anything like put the plug back in, oil back in, and drive it. at that point you didn't give ';Goodyear'; the time to get you a rental car and address the problem. They may have been liable for a set of bearing--but not a seized engine if the damaged is after the fact.

Most of these show a low oil pressure with no road speed---meaning the oil was drained out in order to get the engine replaced.

If you did everything correctly--you won't need a lawyer. I've had this happen to a few customers and myself over the years. This was serviced under a repair contract--read the fine print. they have the right to correct the repair--if you go outside this. You will be liable for your own legal fees. If they can't correct this problem to your satisfaction-- ';then sent in the money, guns, and lawyers; the waste has hit the fan';
i would give the service center a chance to make right have then tow the car back to the service center and have them redo the work you don't need a lawer for this type of case if anything if damage as been done go to small claims Court
if damage has been caused you could go through the small claims court to reclaim off the company who did the original service the cost of the repairs. Its a contractual duty of care issue and they seem negligent.

you would be best advised to start by investigating small claims court.





lawyers are not the solution to everything. all they do is screw you and the other guy because it's just a paycheck to them.





in your case, unless you can prove that the plug falling out was the fault of the service station, you won't win in court. also, you would have to prove that there was engine damage caused by this. unless you have detailed records which show the condition of the engine before and after this event, it is your word against theirs.
